Traumatic Brain Injuries

There is a certain hierarchy when it comes to physical injuries. A cut or scrape can be managed with a bandage, while more serious issues may require a hospital visit and a cast. At the top of this hierarchy sits the traumatic brain injury, which can affect the body’s nervous system and can impact the rest of a person’s life.

When these kind of injuries happen, it’s important to work with an attorney who specializes in traumatic brain injury cases and can guide you and your loved ones through every step of these complex issues. In cases like this, prolonged recovery can mean unmanageable medical costs, lost wages and a reduced standard of living.

You should secure an attorney who understands the intricacies of traumatic brain injury law and how to present brain damage cases before a jury to achieve excellent results.

Gold & Gold’s traumatic brain injury attorneys have been fighting for victims of catastrophic brain injuries for more than 40 years.

While the settlement amounts for traumatic brain injury can vary, it takes an experienced and dedicated attorney to secure a significant settlement amount that will ensure the victim and his or her loved ones are able to receive the proper care and attention they need for the rest of their lives.

At Gold & Gold, this is something we’re familiar with.

When David H. Gold took on a case where a mother’s newborn suffered a traumatic brain injury due to negligence of a South Florida hospital, Gold & Gold secured a settlement of more than $5 million.

The baby was born with a congenital heart defect and immediately underwent corrective surgery. The surgery was successful, but the newborn was required to be re-intubated post-surgery. Unfortunately, the hospital employee failed to successfully intubate the newborn causing the child to lose significant amounts of oxygen to the brain and suffer catastrophic brain damage. Today, the child’s mother is using this settlement to provide and care for her child for the remainder of his lifetime.

Failure to treat and diagnose strokes at hospitals are leaving many individuals with permanent brain injuries. There are stroke protocols that hospitals must adhere to when a patient presents with the signs and symptoms of a stroke.

Recently, we resolved a case for $2.25 million against a hospital and a neurology group for failure to recognize, diagnose and treat a stroke.

Our client came into the hospital within 45 minutes of the onset of the stroke. The hospital did not administer the appropriate medication which would have resolved most, if not all, of the patient’s residual disability. Unfortunately our client has been left paralyzed on the left side of his body due to the failure to treat the stroke.

We were able to prove that this hospital failed to have appropriate stroke alert protocols in place which ultimately caused this man to suffer significant brain damage.

Because our law firm adheres to a strong value system, our attorneys have built relationships based on trust and respect with opposing counsel and insurance companies across the nation. In this case, that helped us negotiate a settlement for our client that may not have been possible otherwise.
